What is the income tax return like for Brazilians abroad?

Living outside Brazil does not automatically eliminate all your tax obligations with the country. Depending on the situation, Brazilians living abroad may need to file an income tax return. Understanding these rules is essential to avoid future problems with the IRS. Check out how it works!

Who needs to file an income tax return?

The obligation to declare income tax depends on certain conditions. Here are the main ones:

  • Income above R$ 30,639.90Wages, rents, pensions, etc., whether in Brazil or abroad.
  • Exempt income or exclusive taxation: Amounts over R$ 200,000.00.
  • Capital gain: With the sale of goods or rights.
  • Stock exchange operationsMovement above R$ 40,000.00 or determination of net taxable gains.
  • Possession of property: Equity greater than R$ 800,000.00 on December 31.

Any of these conditions already makes it compulsory to declare. Be careful not to miss deadlines or ignore your fiscal responsibility.

Do Brazilians abroad need to declare?

If you're going to live outside Brazil for more than 12 months or permanently, you don't need to file an income tax return, as long as you start the tax exit process. This includes:

  1. Notice of Final Exit: Send before completing 12 months abroad.
  2. Declaration of Final Departure: Document formalizing your change in the Brazilian tax system.

Without these processes, the IRS will continue to consider you a tax resident and therefore obliged to file an annual tax return.

Cases in which the declaration is still required

Even outside Brazil, the declaration will be mandatory if:

  • You have goods in Brazilsuch as properties over R$ 350,000.00.
  • Receive taxable income greater than R$ 50,000.00, such as rent or salaries.
  • Making financial transactions or transfers to Brazil that are included in the tax base.

The deadline for submitting the declaration is May 31st of the following year, always taking the previous period as a basis.

Penalties for not declaring

If you are obliged to declare and do not comply, even abroad, the penalties include:

  • Minimum fine: R$ 165.74.
  • Monthly fine: 1% of the tax due, limited to 20%.
  • Notice of infringementIf the problem is not resolved, the IRS may impose additional fines and interest on the amount owed.

The absence of a Final Exit Declaration can also cause problems, as you will continue to be considered an active taxpayer.
