Required documents:
- Invitation letter of the Brazilian contracting company;
- Proof of professional qualifications from abroad;
- Documents required for the RN01 visa (where applicable);
- Criminal record certificate from the country of origin;
- Membership documentduly legalized and translated.
After approval by the MTE, the authorization is sent to the Brazilian consulate in the applicant's country of origin. Only then can the foreign professional apply for a visa.
It is important to remember that the contracting company must notify the Ministry of Labor of the location of the workplace and any changes to it during the period in which they are working. The company must also make a declaration that the foreign employee will not be replacing national labor.
Rules and obligations
- The maximum period of stay with the RN03 Visa is 1 year for the regular modality and 180 days for the simplified and emergency modalities.
- The hiring company is responsible for informing the MTE of any changes related to the professional during their stay.
- Foreigners must register with the Federal Police within 90 days of arriving in Brazil.
Important: the RN03 Visa does not create an employment relationship with the Brazilian company. During the period of validity, the foreign professional remains linked to the employer in their country of origin.
Punishments and precautions
The hiring company must strictly follow the rules established by the MTE. If it hires a foreign professional without the proper authorization, it may be subject to fines and legal sanctions.
A very important labor rule for contractors is the number of foreign employees that can be hired, which cannot exceed the number of Brazilian employees. It is also advisable for the hiring company to check the type of visa (if it is as required) and if it is properly expired.
The RN03 Technical Visa is an excellent alternative for companies that need highly qualified foreign professionals for specific technical services. However, it is essential to follow all the rules and ensure that the legal procedures are followed correctly.
